American Hegemony

The nineteenth century – “the Victorian age” - effectively began in 1815, with the Battle of Waterloo, and ended in August 1914 with the outbreak of the First World War. During that 99 years, the British with their enormous navy and vast overseas possessions, maintained a kind of hegemony which insured almost a century of relative peace in the world and an expansion of free trade that reached its pinnacle at the turn of the 20th century and has not been matched since then.

Bankruptcy Proceedings

Bankruptcy is federal statutory law (Title 11 of the United States Code) based upon the Constitutional requirement for "uniform laws on the subject of Bankruptcy throughout the United States." (Article I, Section 8). Bankruptcy proceedings are undertaken in the United States Bankruptcy Courts, part of the District Court system.

Baycol Lawsuit Lawyer: Baycol Side Effects Litigation

The German pharmaceutical company Bayer AG announced in August of 2001 a voluntary withdrawal of its drug Baycol (cerivastatin) from the US and European markets. Over 31 people have died while taking the drug. They perish of severe muscle breakdown, a rare condition that has been associated with cholesterol-lowering drugs like Baycol. Baycol has been used worldwide by over 6 million people, and it will remain on the market in Japan where gemfibrozil is unavailable.

No time breakdowns, no list of activities performed or equipment and supplies used—just a final, usually shocking, charge.

Business Name – How To Pick One From A Legal Perspective

A business name can be a huge factor in the ultimate success or failure of the entity. Unfortunately, many people fail to give a lot of thought to it prior to moving forward. There are many factors to consider including something memorable, a name related to your area of work and, potentially, the availability of the domain name.

California Limited Liability Company – An Overview

Limited liability companies (“LLC”) are a fairly popular business entity choice for small businesses. The popularity stems from the fact that the entity provides the asset protection of a corporation, but the relative tax simplicity of a partnership.

Cases Involving Defective Products

Each year, millions of people are being harmed by defective products. A defective product is a product that causes injury or harm to a person. A product may be considered to be defective for many different reasons such as design defect, failure to warn, failure to guard, unfit for intended use, defect in construction, or a defect in materials. With this, defective product claims can be based on negligence, strict liability, or breach of warranty of fitness depending on the jurisdiction within which the claim is based.

Class-Action Lawsuits – Can They Help You?

Recent withdrawals of Vioxx and Bextra have renewed interest in class-action lawsuits. What is a class-action lawsuit?

Class Action Lawsuits and Unethical Settlements

A trend has now developed in which the plaintiff class counsel compete with one another to offer the best and most sweeping settlement terms to defendants, and these settlements generally contain a global release of all claims in other fora. Once these global releases are approved and entered as part of a class action judgment, the releases effectively extinguish or bar related actions by class members in any other states and jurisdictions. An attorney who wishes to conduct his class action practice in a diligent and ethical manner can be harmed by the unethical behavior of some class counsel who use claims in other fora as a bargaining chip to maximize the settlement terms for their own fee award.
